If we take the first point first and the second point second, I see the abuse as being that of second-guessing the diocesan bishop in an area that is uniequivocally exclusive to him. The second point is subordinate. It is instructional. It is not universal.
If a priest is holding CS without permission of his bishop, then he is in the wrong. If the bishop has granted permission for certain times to be a CS, then he might be prudent or imprudent, but not abusive.
