But the filibuster is only needed if the Republicans get 60 seats in the Senate.
Something I don’t think is even possible this time around.

John

No it isn’t possible. The Republicans would have to wait until the elections in 2014, to have a chance of getting a 60 seat majority in the Senate.

Jim

Not to repeal an existing law, you need 60. At least that’s what I read this morning.

I’ll try and find the article between plays in the New England/ Tennessee game.

Jim
Matthew Yglesias is saying mixed things. Here he says the filibuster will not save ObamaTax from President Romney
South Dakota Sen. John Thune, chairman of the Republican Conference, said budget reconciliation could be a “vehicle” for repeal, promising Republicans would make “every attempt” under a GOP Senate majority and Republican White House to do just that.
“I’ve already heard discussions that it can be done through 51 votes in the Senate, which is an easier threshold,” said Washington Rep. Cathy McMorris Rodgers, a member of House GOP leadership and a key Romney adviser.
“With a 50-vote majority in the Senate, Republicans could do the same thing Democrats did with 50 votes on Obamacare — and that is to use the reconciliation process — to reverse the more onerous provisions of Obamacare and replace them with what Republicans have been talking about,” Senate Minority Whip Jon Kyl (R-Ariz.) said.

Republicans have no chance to take control of the Senate, until 2014.

If they did take control, they’d need 60 votes to fight off the filibuster the democrats would launch.

By then, the nation is already 2 years into most of Obama Care.

So, Ryan saying Romney is going to repeal Obama Care the first day in office, is not true.

Jim

I’m glad you admit that…although I know it’s a typo. But your mistaken point is correct:

Yep, they have spoken about it for a LONG time. The President DID something about it.

John
The Germans grumbled for a long time about their plight after World War I. Hitler did something about it too.

Tax bills can be repealed with a simple majority.

Well, guess you told me,

John

Here’s another article;
Why Romney Won’t Repeal Obamacare
But if it does, in order to become law, Romney’s repeal of the A.C.A. would face a battery of three separate tests requiring sixty Senate votes: one to bring the legislation to the floor, one to start the debate, and one to end the debate. The filibuster, the G.O.P.’s favorite parliamentary device of the Obama era, would now be the Party’s great enemy.

50 votes finishes every thing in the health care law that is budget related like the mandate, insurance exchanges and subsidies, medicaid expansion, taxes on providers and insuers and the independent payment advisory board, closure of medicare part ‘d’ donut hole,

You need 60 votes to get rid of the pre existing conditions rule but Romney has said he would keep that so that would be an issue

No, it requires 60 votes, just as the articles I’m presenting state.

We’re talking about repeal of a major piece of legislation, which already has portions of it in effect.

Jim

Articles you are posting are correct in that certain portions of ObamaTax need to be repealed with 60 votes, but every thing budget related can be repealed with 50. Republican senators and left blogs are saying many parts can be repealed with 50

No citizen of the US should be denied good health care because their state chooses no to supply it.
I believe you are referring to no one being turned away at the hospital. This is one of the major problems with health care today.

Many people, lacking health care coverage, wait until the situation has reached an emergency condition. They then go to the hospital which cannot turn them away for lack of insurance. Does that mean that the care is free? Of course not.

We are all paying right now for the uninsured. Giving people equal access to preventative care could not help but reduce emergency room visits, by far the most expensive form of care.

John
Actually, I was referring to your statement that no citizen in the US should be denied good health care. Again, who is being denied good health care? If there is an Equal Protection issue, you should be able to articulate it.

And I can guarantee you, after what Romney said on Meet the Press this morning, he will not repeal Obama Care, but he’ll modify it where he can.

I actually trust Romney with Obama Care, but he’s not going to do what you hope for,

Jim

And I can guarantee you, after what Romney said on Meet the Press this morning, he will not repeal Obama Care, but he’ll modify it where he can.

He will certainly not leave it unfunded.

Jim
Romney did not say modify, he said he would replace it. Keeping in place an unpopular law would do not him any favours

If you want to believe Romney will not repeal it that is your choice, I see no evidence for such a belief and do not agree

If there is an Equal Protection issue, you should be able to articulate it.
I believe I did…people, lacking access to basic health care are forced to wait until they no longer can (emergency situation). I believe it is not out of line to assert that it is far preferable to treat illness in its early stages.
Since many do not have access to that type of care, it could argued that they are being denied “good” (a subjective term) health care and therefore equal protection.

You and I will not agree on this, that is apparent…both may be wrong, but one almost certainly is.

John

Romney never said modify, he said he would replace it
And when Gregory asked about the present parts of Obama Care that are in place now, Romney said tehy were the good parts and he would leave them.

Sounds like a modification, not an replacement or repeal.

Jim

On top of that, some budget experts believe not every part of the health care law could be repealed using the simple-majority rules of reconciliation — only the parts that have a direct budget impact. Still, major portions, including the individual mandate, could be targeted by reconciliation.

“The reconciliation process that was so horrible and abnormal?” said Rep. Rob Andrews (D-N.J.), a key player in passing health care, referring to past Republican complaints that reconciliation was illegitimate. “That reconciliation process? It was legitimate to use it in ’09, it would be legitimate to use it to repeal it. It actually would. I’m sure that’s what they’d try to do.”

Rep. Chris Van Hollen (D-Md.), ranking member on the Budget Committee, acknowledged that “theoretically” it’s possible but dismissed the chances that Republicans would succeed.

“This is under the fantasy world where they control everything,” Van Hollen said.
