In the coming weeks a document of Benedict XVI will be released which reorganizes the competences of the Congregation for Divine Worship, entrusting it with the task of promoting a liturgy more faithful to the original intentions of Vatican II, with less room for arbitrary changes, and for the recovery of a dimension greater sacredness.
The document, which will take the form of a motu proprio, is the fruit of a long maturation - it has been reviewed by the Pontifical Council for the Interpretation of Legislative Texts and the offices of the Secretariat of State -, and is motivated mainly by the transfer of jurisdiction over matrimonial cases to the Roman Rota. These are the so-called “ratum sed non consummatum” causes, i.e. regarding the marriages which took place in church but have not been consummated because of the lacking carnal union of the spouses. There are about five hundred cases a year, and they mainly affect some Asian countries where there are still arranged marriages with girls of a very young age, but also Western countries for those cases of psychological impotence to perform the conjugal act.

For starters, what was mentioned (promoting the liturgy) is already within the competence of the CDWDS, so there’s nothing new there.

The blog post doesn’t make a lot of sense.

Here’s the next paragraph:

I don’t see how not dealing with a particular type of marriage case means that the CDWDS will “not be concerned anymore with the sacraments.”
“B” just doesn’t follow from “A”

Is the Holy Father going to limit the CDWDS to strictly matters dealing with the Mass itself? to the exclusion of the other sacraments?

What I can see happening is that the Holy Father might be directing the CDWDS to be more proactive rather than reactive. That would not surprise me (or I daresay, most others) in the least.

The whole post is a translation of an article in Italian. I rather think that much has been lost in the translation.

We’ll just have to wait and see. Meantime, let’s keep a lookout for this new motu proprio because it looks like it will have some very interesting results.
 
I would have thought that the Rota would be the logical body to deal with *ratum sed non comsummatum marriage *cases. After all, these cases have nothing to do with the way the sacrament was celebrated but with something (they mention specifically psychological inability to have intercourse) that happened after the marriage was celebrated. It would certainly seem to fall outside the purview of the CDWDS.

Well, yes and no. All marriage cases still deal with a sacrament (or an invalid attempt at a sacrament). And, in spite of what was said in the blog, not all of these attempted marriages have to do with psychological issues–here in the US, many “marriages” happen for the sake of immigration, and people get “married” but never consummate the marriage because all they want is a piece of paper to show to the immigration office.

In any case, moving certain marriage issues from one office to another at the Vatican isn’t going to have much impact on the average Catholic. In that sense, this isn’t exactly earth-shattering news.

What does seem to be important though is how the Holy Father is going to change the way the CDWDS (if indeed he even keeps the name) does what it does. If the information is accurate, we may see a change in their “tone” when it comes to liturgical matters; and that may very well have an impact on Catholics day-to-day.

We’ll still have to stand-by and wait for the letter itself to be made public.
 
That only makes me more confused. Again, I cannot understand what is being said–it just doesn’t make much sense.

What “dispensations” is he talking about? Should it have said “jurisdiction” instead of “dispensation”?

I can certainly understand that specific questions about validity will be addressed to the Rota from now on, rather than the CDWDS–I think maybe that’s what’s being said.

When Tornielli writes, above, that the Congregation will no longer deal with sacraments, he is talking about validity. In most matters the Congregation for the Doctrine of the Faith determines whether sacraments in concrete cases were valid or not.

Still confused…🤷
