I often wonder what these bishops do and say to the spouse who comes in, literally black and blue from the most recent physical assault.
No fault divorce was at least in part a reaction to the fictions which were perpetrated on courts by people who simply did not wish to be married to each other - as well as those where there was physical and/or emotional violence on a regular basis. Sadly, it became its own problem; but going back to what was required as proof before no-fault not only will not put the genie back in the bottle, but will not address very real problems.
And while the Church does not at all favor divorce, unless it wants to change its current procedure of not examining a marriage re: validity/impediments leading to a decree of nullity, preventing divorce leaves people who are not in a valid marriage between the rock and the hard place.
