S. Dakota legislature passes abortion ban

SIOUX FALLS, South Dakota (Reuters) - South Dakota became the first U.S. state to pass a law banning abortion in virtually all cases, with the intention of forcing the Supreme Court to reconsider its 1973 decision legalizing the procedure.The law, which would punish doctors who perform the operation with a five-year prison term and a $5,000 fine, awaits the signature of Republican Gov. Michael Rounds and people on both sides of the issue say he is unlikely to veto it.

“My understanding is we are the first state to truly defy Roe v. Wade,” the 1973 high court ruling that granted a constitutional right to abortion, said Kate Looby of Planned Parenthood’s South Dakota chapter.

State legislatures in Ohio, Indiana, Georgia, Tennessee and Kentucky also have introduced similar measures this year, but South Dakota’s legislative calendar means its law is likely to be enacted first.

“We hope (Rounds) recognizes this for what it is: a political tool and not about the health and safety of the women of South Dakota,” Looby said.

i wonder if they realize that the Federal courts will adhere to precedent, sending it up to the Supreme Court, but then the SC can just refuse to hear it. this has been dealt with many times before, and the SC can just say, “Forget it, weve already been down this road”.

the SC refused to hear arguments by Roe herself after she said she had changed her mind. nothing has changed since then, except the justices. they re banking on alot by counting on the SC to actually hear this case. their last ruling on the partial birth issue was short and very strict (narrow) in nature. they just directed Federal courts not to take the most “blunt remedy” when dealing with 3rd trimester abortion restrictions. this was already established in Roe, with states being allowed to restrict and regulate such.

they have to get over Casey, Doe, and then Roe 2 refusal, then get rulings that Griswold and Eisenstadt v. Baird dont extend privacy as far as abortion. then there is Lawrence vs Texas too.

they swung for the fences this time, probably as mid-term elections are rolling around so they can use this as a plank in their platform. if you will notice that this bill still allows birth control pills, morning after pills, IUD, and Depo, as well as mentions NOTHING about travel out of state to obtain an abortion.

if this fails to overturn Roe, then the other 5 states trying to pass similar legislation wont even get heard by the SC. they will say “Please see Planned Parenthood vs South Dakota”, and send it right back down to lower courts decisions.

they cant have it both ways. you cant have Congress have the ability to severely restrict abortions, while still maintaining that abortion is a state issue. if Roe goes down, then it essentially sends it back to states and strips Congress of the ability to use “Interstate Commerce” as a justification.

hence, about 25-30 states will still allow many abortions, with no restrictions possible on interstate travel to a pro-abortion state from an anti-abortion one. that means, there can be businesses setup to pickup and transport women from anti to pro abortion states. it is done with gambling all the time. and that attempt by Congress to prohibit it was shot down.
 
I just saw that. I wonder how many hours it will be before some Activist Judge, declares it “Unconstitutional”

South Dakota Did It!

Pierre, SD – Yesterday, South Dakota became the first state since the 1973 Roe v. Wade Supreme Court decision decriminalizing abortion, to pass a statewide ban on the procedure. The State Senate gave final approval to the abortion ban, HB 1215, with an overwhelming vote of 23-12. The measure now awaits the signature of Governor Mike Rounds, who has not indicated if he intends to sign the bill into law.

 Operation Rescue President Troy Newman was in Pierre last week to hand-deliver letters to lawmakers from Miss Norma McCorvey in support of the abortion ban. McCorvey was the “Jane Roe” who filed the original petition that would eventually allow abortion in America. McCorvey has since has since converted to Christianity and now actively works to end abortion.

 “We are encouraged that South Dakota has shown courageous leadership in protecting the most vulnerable among us, the pre-born,” said Newman “We urge Gov. Rounds to sign this historic and bold legislation,” said Newman. 

 Gov. Rounds has expressed concern that the law will certainly be challenged, and that the cost of litigating this legislation to the Supreme Court level will be a difficult burden for his small state to bear.

I am very hopeful that this works out for the best (in fact, I started the other thread on the subject). Also, I recently learned of a petition drive in my state for similar legislation (stating that life begins at conception).

However, this is very risky at this time. If SD Bill 1215 gets signed into law and subsequent challenges bring it through the court system, rulings against the law will have a negative impact on future attempts to strike at the Roe v Wade decision.

But, I think the wording of the Bill is very effective. In light of the approach used, it is easy to see the shortcomings and nearsightedness of the Supreme Court’s ruling in 1971. It was not a legal solution but a political one. It was not based upon medical evidence but rather oblivious to it.

This is great news!!! My friend just called me this morning to tell me about it. I think we’ve got some justices on the SC right now that will look at Roe v. Wade for what it really is: a smokescreen with no basis in the constitution. Like Janet Folger told me, “The time is soon coming when we will see Roe v. Wade overturned. WE WILL WIN.”

House sends abortion bill to Rounds [our Governor]

PIERRE – As the South Dakota House of Representatives gave final approval today to a bill aimed at banning most abortions and creating a U.S. Supreme Court challenge to the 1973 Roe v. Wade decision, Gov. Mike Rounds said he’s inclined to sign it.

The House gave final approval to the bill with a 50-18 vote Friday afternoon.

At a press conference Friday morning, Rounds said he will sign the bill if he determines that it can save lives.

“I’ve indicated I’m pro-life and I do believe abortion is wrong, and that we should do everything we can to save lives,” Rounds said. “If this bill accomplishes that, then I am inclined to sign the bill into law.”

Our state has passed this precisely so the SC takes another look at Roe vs. Wade.
 
We’re gonna have to storm Heaven with our prayers. Planned Parenthood is going to throw EVERYTHING they have to state that this bill is unconstitutional. If PP spends A LOT of money at this and (knowing this bill WILL hit the U.S. Supreme Court) loss. This would be a big blow to them financially and organizationally.

Try to make this one of your main intentions during prayer…especially during Lent!

I heard about this on NPR yesterday. It’s wonderful news, hopefully the beginning of a turnaound on the abortion issue! This coupled with the SC’s hearing of the partial birth abortion case gives me hope! Thanks be to God!

Any “right-thinking” person should be thankful if the SD ban is overturned. After all, only “wrong-thinking” people would ever dare use the laws to impose their values on others.

What? What’s that? Abortion imposes others’ values on the unborn? Well, yeah, but that’s different.

I’d read somewhere that Gov Rounds was supporting a grassroots campaign to raise money for legal fees in the effort to protect this bill.

Does anyone know of an address or website for contributing? I think I read that he was calling for a $10 per person suggested donation.
 
I read about that… I’d like to know where to send a donation to myself.
