Gee, so as to keep the community safer, the police let an alleged rapist with previous convictions for rape go free rather than notify ICE?

The idea of a sanctuary City is merely the idea that a local law enforcement agency will not report people to ICE, and often will not preform what are called “ICE Holds.” An ICE hold is when a person is suspected of being undocumented and ICE wants to arrest them. ICE then asks a local law enforcement agency to arrest that person and hold them in jail for up to 48 hours, not including weekends and holidays (so it could be for up to five days). ICE will then usually show up and take custody of the person.

Some local law enforcement agencies do not like to cooperate with ICE for many perfectly valid reasons. Among these are: 1) they get nothing out of the deal - ICE will not reimburse local agencies for detaining people at ICE’s request 2) ICE will not protect them if a person is wrongfully arrested 3) ICE does not always show up 4) Local law enforcement has better things to do than do ICE’s job for it 5) Local law enforcement has no legal authority to arrest people for immigration violations (which are rarely criminal anyway), and they may open themselves up to liability 6) Sometimes they believe in the principle of subsidiarity and believe that they can deal with any problems on the local level better than the federal government.
 
Well, this is getting into complicated territory.

I think that those are all valid points, but when the cities doing this call themselves sanctuary cities they are thumbing their noses at the federal laws, which I think is wrong.

And when they release violent criminals here illegally that that is not keeping the community safer. It’s not as if they “have ties to the community” which will keep them from taking off to somewhere else. It’s not as of they would be easy to find.

We have enough of our own criminals without releasing criminals who shouldn’t be here anyway to prey upon vulnerable populations here.

Go free??? Where did you get this idea? It sure wasn’t my post. ICE deports people, that sets them free, just somewhere else. Law enforcement is the one who prosecutes people, that is, locks them up. Most rapists repeat precisely because it is hard to report this crime for many people. The absolute last thing that is needed if this crime is to be enforced is adding and additional layer of distrust of police among the communities they serve. I know that our president has perpetuated this sort of boogeyman stereotype of immigrants for political gain, but the only way I see this makes logical sense is if somehow rape, murder, or assault against illegal immigrants is unimportant, and only crime against red-blooded Americans matter.

This sort of attitude is exactly why subsidiarity is needed in law enforcement. Police in San Antonio, for example, are paid locally to protect people the people of San Antonio, not scared politicians in New York, that have zero personal knowledge of what illegal immigrants are actually like, or how to best serve their citizens.

Case and point: there has been at least one case in which an undocumented woman was beaten by her husband. ICE arrested her after she reported the crime. Why would any undocumented person ever report a crime again?

That is the only objection I know. In fact, reporting those who go to prison is pretty much the norm. Actual convicted criminals are the ones who are deported with local cooperation.

How many times have we heard that if you don’t like the law, change it, even on this thread. So, if the law does not mandate local cooperation, and the Trump ICE enthusiasts do not like it, then change it. Until then, let local police do what local police think best.

The issue of those accused of crimes is a little tricky, but I don’t think we should be ignoring their illegal status here if they are repeat offenders. All too often, they are released on their own recognizance, never to be seen again, but loose in the US, where they generally prey upon poor Hispanic immigrants, legal and illegal.

Just so you know, that is exactly the definition of a Sanctuary City.
 
I posted the update where 400 of these cases would be reexamined to see who could stay.

But what about circumstances where people are get mixed up with the law for something simple like a ticket?
 
The likelihood of someone’s going to prison for a ticket is extremely low.
