The priest should be suspended ad divinis for filing the civil suit in the first place. His proper appeal is to the Holy See of Rome, not the civil courts.
Not a particularly fresh thread, but… according to the article, it was the parish that filed the suit, not the priest.

His failing to tender a resignation upon a removal order is close enough to complicity; I can’t see a suit going forward if the priest had been obedient and party.
 
The big question in my mind is what happens next. Did the bishop give up? Or appeal it somehow? Or is the only way of dealing with it tearing down the rectory? (I’m not sure how to put the smile sign in here). If anyone hears about what is happening, I would greatly appreciate a post about it on this thread.
