Say a little prayer! Texas is changing it’s death penalty laws. It is finally going to allow for either Death or Life with out the possibility of parole during a sentencing hearing. This is a huge step in the right direction. Texas juries have never had the choice between a true life sentence (without parole) or death. I won’t be shocked if texas juries decreasing in giving out death as the sentence with this new option. I hope and pray!!!

House Approves Life-Without-Parole Bill

**AUSTIN, Texas – **With a vote that death penalty opponents hope will reduce the number of executions in Texas, the House gave tentative approval Tuesday to providing juries the option of sentencing capital murderers to life in prison without parole.

Currently, Texas juries can sentence capital murder convicts to death or life in prison with the possibility of parole after 40 years. Of the 38 states that execute capital offenders, Texas and New Mexico are the only ones lacking the life-without-parole option.

The bill approved Tuesday on 104-37 vote would take away the parole option, a move that has been criticized by some civil liberties groups.

Texas leads the nation in executions, having put to death 344 inmates since the state resumed the practice in 1982. Texas has given lethal injection to eight inmates this year after killing 23 in 2004.

The life-without-parole option has already passed the Senate. A final House vote of approval on Wednesday would send it back to the Senate, which must consider House amendments that tweaked the bill. The legislative session ends Monday.

A Scripps-Howard poll in October found that 75 percent of Texans support the death penalty and 78 percent favored giving juries the option of life without parole.
 
That is good news. As I understand, our own laws also didn’t provide for a true life sentence. So there were more death penalties meted out than necessary. But juries were fearful of someone getting life and being out in ten years due to good behavior. In the NW even the most HEINOUS crimes do not warrant the death penalty anymore.

I don’t think it will make a bit of difference. Oklahoma has the life without parole but on a per capita basis we execute more prisoners than Texas. From the DOJ website:

In 2003, 65 persons in 11 States and the Federal system were executed – 24 in Texas; 14 in Oklahoma, 7 in North Carolina; 3 each in Alabama, Florida, Georgia, and Ohio; 2 each in Indiana, Missouri, and Virginia; and 1 each in Arkansas and the Federal system.
 
since prisons in Texas are a fast growing for-profit business, sounds like a winner. having seen the Texas justice system close up from the inside out, I would not trust any judge or jury anywhere to render an honest verdict in a capital case.
