Texas man wants pregnant wife off life support despite state laws

Just want to clarify my positioning

I want to see further testing done to determine viability of the baby.

The mother is dead. We can readily see that.

But the baby may be injured severely as well, and we are simply postponing the inevitable.

We simply do not know without tests.

As to the judgements we have seen concerning the father, I do not believe I would release the hospital either. It is no one’s business. Those that judge haven’t sufficient information and will likely stand in their own harsh judgement criteria later.
The best conclusive test, and it is 100% accurate, is after birth see if the baby is alive.

"Attorneys for the family of a brain-dead pregnant woman who is in life support in a Texas hospital said Wednesday they have medical records showing the fetus is “distinctly abnormal.”

They issued the statement, they said, to clear up any “misconceptions about the condition of the fetus.”

Erick Munoz, the husband of 33-year-old former paramedic Marlise Munoz, has filed a lawsuit against John Peter Smith Hospital in Fort Worth seeking to remove her from life support.

He said her wishes were not to be kept alive in such a state."

The information about the baby is really sad. It is a wonder that he/she has lived so long. 😦

As to the lawyers argument, it just seems really odd to me. They are arguing that she is both alive and dead at the same time. She is either one or the other, not both.

The point about pregnancy tests for dead people is beyond nuts. :jrbirdman: This is just one of the many examples of why there are so many lawyer jokes.

So they are using the typical pro abortion argument that the health ( or lack thereof) of the baby is reason to kill it by removing life support. Why am I not surprised.

Yes, the lawyers of the same father that has said some controversial things regarding the baby IMO and the same father that is fighting in court to make sure the baby never gets the opportunity to be born is now using the pro abortion tactic of claiming that the lack of perfect heath of the child is reason to make sure it dies before viability by removing life support. Sounds familiar. I’ll take their claims with the same level of confidence as I do other pro abortion groups and individuals.

Right. While at the same time, the hospital attorneys are prevented from saying anything.
I will only believe what the doctors at the hospital say-- but of course they can’t say anything because Mr. Munoz won’t let them.

Then I guess they wouldn.t mind if the hospital releases all the records in this case, not just the one’s they choose to cherry pick. I believe these lawyers as much as I believe O’Bama. “You can keep your Doctor.”

This is all so sad. and sadder still if the baby dies after birth after all this.

Praying.

So I take it the lady isbrain dead? If she is dead, this is an experiment that shouldn’t happen. Let nature take it’s course.

Mr. Munoz is under no obligation to provide personal medical information to you or anyone else in the public. Medical information is private. I am stunned that people on this forum are taking him to task for not releasing this information.

I agree that the records are private. However, if you run to the media to get support for your decision, people are going to want to know details. It’s just human nature. Don’t talk to the media if you don’t want others involved.

It looks like the hearing set for tomorrow, so the decision will be soon.

I’m curious, though, if the hospital agrees with Munoz, but believes they are are bound by the law or if they have a different opinion than him and are using the law to back them up. From the little bit of info that has been released, it seems as if the hospital doesn’t agree. If they did, then why is Munoz suing the hospital rather than going after the law with the support of the hospital?

“You’re clearly trying to balance the potential life of the fetus with what the family and deceased would have wanted,” said Arthur Caplan, a former University of Pennsylvania bioethicist now at New York University.
“It’s not a matter of being pro-life or pro-choice to me,” he said. “It’s more nuanced. I’m not denying there’s a fetus to think about. But there are so many uncertainties. I’m willing to think the family and husband should decide what’s best, and not the Texas legislature.”
John M. Haas, president of the National Catholic Bioethics Center in Philadelphia, says Texas law no longer applies, since Munoz is dead. He says the family should make the decision now, and a big consideration is the viability of the fetus.
“The people think the Catholic Church is black and white on these things, and we’re not,” he said. “We accept judgment of physicians. . . . It seems to me that if it were highly likely that the child could survive if the corpse was kept functioning for another week, there would be a strong presumption of doing that.”
But if there were little chance the fetus would be viable, he said, the opposite would be true.
“If the child was deprived of oxygenated blood,” he said, “do you have to use extraordinary means to keep the child alive? The answer would be, no, you don’t.”

I would request that this poor man not be judged harshly.

I hope he is receiving pastoral care along with his in-laws. It is a horrible situation for all, the parents of Marlise, her husband for Marlise and her unborn child.

Praying for this family.

😦

So does abnormal mean a handicap or does it mean that the baby will not survive?
abnormal is anything that isn’t “perfect” in today’s world. It could mean a cleft lip (minor) to brain damage caused by the mother’s condition that caused her “death”.

Based on the description in the article, “abnormal” in this case is very serious. Hydrocephalus, heart conditions, and lack of limbs are not minor conditions.

We should all be praying for this baby and the family.

Totally agreed.
