I think that is a philosophical position, and not a fact. It looks like a form of positivism applied to land rights. Under positivism, one has what ever rights that one can assert and enforced. Another philosophical viewpoint is naturalism, where one believes rights come from nature or God.It’s been a fact for centuries.
