Unprofessional previous boss

I don’t want to get all into a previous job with an older crazy boss, but they owe me a paycheck for 2 weeks worth. I filled out a w-2 and gave the accountant that does the payroll for his employees a voided check of mine so that I can get direct deposit. Anyway, I wasn’t supposed to get paid last week but I noticed I didn’t get any pay added into my account from him. So, I emailed the accountant but she only works one day a week for him and so I decided to email him also just to make sure everything was fine or that they remembered. He emails me and says:
Nicole cut a direct check and mailed it herself
Didn’t want to add to payroll account
She paid you full amount and did not take taxes out
Please contact her with any questions

I really hate dealing with this and I always make sure in any job I take that taxes will be taken out of my paycheck. So, I told him my concern and that if she’s not able to take taxes out that I will mail the check back and to not worry about it. This is what he emails me back:

’ Holly we will send you a 1099 at the end of the year . It is not worth for her to add to payroll. Please leave me alone’

He has bad tempers so I had a feeling when I emailed him he would get irritated, but I wanted to know what was going on. I feel it’s not right how they just decided to not add me to the payroll when I filled out a w-2. I really don’t want to deal
With any 1099 either.

Can I take any legal action about this? Is it illegal for him to do that? And also, I was thinking maybe I can just donate the check but would I still have to pay taxes on the money at end of the year?

It is only 2 weeks worth so I would not worry about it.
A 1099 form is no big deal.
If you still have questions I would recommend communicating with the secretary instead of the boss; that is her job and he does not sound helpful.
Yes, you will have to pay taxes on all income. Don’t send it back to them. They are required to report it to the IRS so you have to account for it it also.

Yes, it’s annoying that they didn’t take the taxes out, but a 1099 is not a big deal. You will probably end up having your refund be a little smaller or owing a little next year, but even if you do your taxes yourself it won’t be hard to figure out.
 
Sometimes it can take awhile for an employee to be added to the payroll system. If you only worked there for two weeks, it probably does not make sense to add you. Also, often if your payroll amount is small enough, federal tax isn’t taken out initially anyway. It really isn’t that complicated- just wait for your 1099, and report it like your other income.

You should stop bothering your boss about this- if you have questions, ask the accountant and wait for a response. It doesn’t sound like they are doing anything wrong.

It is against forum rules to give legal advice. We cannot answer these questions. It is a question for an attorney, the IRS, or the department of labor.

However, for a two week stint at a company, I think you would be wasting your time with an attorney.

I don’t know why you would donate the money. But whatever you do with it, yes you will owe taxes on it because it is income. Donating it doesn’t make it “not” income.

We are talking about a small amount of money here. You may not owe any taxes at all depending on your overall income for the year.

You are correct. This is not the first job and payroll issue for Cupcake. It also sounded familiar to me.

Looking at threads, it may be a different job because that one was a year ago, and only lasted 2 and a half days. Same scenario.

Cupcake-- perhaps you need some vocational counseling.
 
You might want to check with your state labor board, sometimes they can make waves and encourage the employer to do the right thing. If they are going to pay you with a 1099 the least they can do is increase your pay the SS tax they would pay.
 
Cupcake, I think you should save most of the money in a credit union or a night stand for emergencies. (There are usually one or two that pop up. 🙂 )

If you take about ten or twenty dollars of it have a mass said for your former boss. It’s good for them and good for you.

Some vocational counseling as 1ike suggested is also an excellent idea. But, I can recommend a book by Don Aslett “How to be Number 1 with your Boss”. (It’s not implying that your boss is perfect. Understand, you are going to be dealing with imperfect people the rest of your life.) You might want to swing by the library and get a couple more books on ‘dealing with difficult people’.

Seconded on the IRS hotline. Those guys will be the best positioned to address your problem, i.e. the law in action as applied — and mostly written — by them, versus the law on the books that many lawyers fail to move beyond.

The IRS will also know what to do with the company if there’s need to report it.

The ‘please leave me alone’ line of comment is unfortunately something growingly common throughout the Anglosphere (not just Americans but Brits as well) these days. The same old emphasis on privacy as in the old days, minus the politesse. It has suddenly become acceptable to speak like that, whereas to us old-fashioned folks the sheer rudeness of it still stings like a mortal slight. Not that you won’t find similar patterns among other nations. Education and manners are going downhill worldwide.

As they are issuing you a 1099, you will have to pay both sides of SS & medicare WH. if you arent an indepenent contractor, they could be in violation of labor laws and are possibly trying to not pay their portion of payroll taxes. How long did you work there? Were you under their control (ie they told you how to work, what they wanted, etc)? or did you work independently?
 
Cupcake, stick with the next job you have for a year at least, unless they are making you do something immoral or unsafe. (Driving to different buildings doesn’t count, by the way, even if it wasn’t in the job description.) Then you won’t have this issue. I also recommend not leasing luxury cars.

I concur it may be a desire to avoid paying employer payroll taxes, but we cannot give legal advice. We can, at most, direct her to the IRS hotline, the department of labor, or a lawyer.

This has happened a couple of times with Cupcake.

One job she only stayed 2.5 days.

This one she is referring to she stayed for 2 weeks.
 
Why on earth would you not just cash the cheque 🤷

No one likes to deal with the tax man but it is part of life
