I don’t want to get all into a previous job with an older crazy boss, but they owe me a paycheck for 2 weeks worth. I filled out a w-2 and gave the accountant that does the payroll for his employees a voided check of mine so that I can get direct deposit. Anyway, I wasn’t supposed to get paid last week but I noticed I didn’t get any pay added into my account from him. So, I emailed the accountant but she only works one day a week for him and so I decided to email him also just to make sure everything was fine or that they remembered. He emails me and says:
Nicole cut a direct check and mailed it herself
Didn’t want to add to payroll account
She paid you full amount and did not take taxes out
Please contact her with any questions

I really hate dealing with this and I always make sure in any job I take that taxes will be taken out of my paycheck. So, I told him my concern and that if she’s not able to take taxes out that I will mail the check back and to not worry about it. This is what he emails me back:
’ Holly we will send you a 1099 at the end of the year . It is not worth for her to add to payroll. Please leave me alone’
He has bad tempers so I had a feeling when I emailed him he would get irritated, but I wanted to know what was going on. I feel it’s not right how they just decided to not add me to the payroll when I filled out a w-2. I really don’t want to deal
With any 1099 either.
Can I take any legal action about this? Is it illegal for him to do that? And also, I was thinking maybe I can just donate the check but would I still have to pay taxes on the money at end of the year?
