Why do people say that there were laws in the U.S. against being homosexual when the law was against sodomy?

As the law was written, heterosexuals were not allowed to commit sodomy either. So, why do people say that these were laws that singled out homosexuals?

For the simple reason that Sodomy (anal sex) is the prevalent sexual activity amongst male homosexuals, with oral sex (also illegal) being a close second.
Strictly speaking, Lesbians are not able to perform Sodomy with each other, and in the past, the law did not much care about what women did with each other in bed, It was only in large cities where there were bars in which Lesbians gathered, that the law took notice of them.
Both male and female “Gay Bars” were a major source of corruption for Police Forces in that they were largely Mob owned and were willing to bribe the police in order to exist.

Anti-sodomy laws varied by state. According to this article, some states did single out homosexuals and even in states where the law applied to everyone it wasn’t enforced against heterosexuals as rigorously.

You’ll have to come up with a better source than Wikipedia. But assuming that homosexuals were sometimes singled out in the law, can you name an example of a homosexual that was actually convicted and put in prison for it? Would homosexuals still be against it if the anti-sodomy laws didn’t single out homosexuals?

glapn.org/sodomylaws/sensibilities/introduction.htm has loads of citations of cases throughout numerous states showing people who’ve been arrested and imprisoned for violating sodomy laws.

The threat of sodomy laws wasn’t merely jail time, but being outed publicly (the names of those arrested were often published in the paper.)

Archaeopteryx,

Can you name specific people who this happened to in the United States? I didn’t see specific names mentioned in the link you gave. And I know that homosexuals are singled out in Muslim countries, but I want to know about sodomy laws and their enforcement in the United States.

Do a Google search “anti sodomy laws U.S.”

It goes on and on. I’m sure you will find your answer there…first hand.

While I was able to find some convictions for the crime of sodomy none they don’t seem to be example cases of some one being singled out; most of the examples that I found were examples of some one forcing sodomy on an unwilling participant. The exception being some group of males called the Bolton 7. But for them it wasn’t just sodomy, but that the age of consent for homosexual sex was different (higher) than heterosexual sex and one of the participants was under the homosexual age of consent by 6 months. It was also still illegal for more than two people to engage in sexual activity.

Names:
  • Gary Abdie
  • Terry Connell
  • David Godfrey
  • Mark Love
  • Jonathan Moore
  • Craig Turner
  • Norman Williams

So, the enforcement of it in the U.S. was administered in cases that most people would consider acts of criminal perversion is what I’m getting from this.

Concictions seem to have been successful under cases with othee circumstances. I cam across references to othercases without successful concictions. The only cases i found without other circumstances were outside the USA. Ex:Alan Turing was chemically castrated after he filed a legal complaint of theft against his sex partner. He was convicted of what i think they called “buggering” (sodomy).

I thought sodomy laws were done away with long ago, but I still hear people being charged with sodomy on the news, quite frequently too…?? How is law enforcement getting away with this?

You would have to look at the details of the case. In some states if some one forces another person to perform a sexual act (ex: oral sec at threat of life) it may be charged in the court system as sodomy, which may be a lesser charge than rape. I think what you are seeing on the news is distinctly different than two same gender people engaging in consensual sequel activity in privacy.

The gay activist community has been extremely successful in convincing the larger public that “gayness” is the defining characteristic of their soul. Thus, any law that prohibits the carrying out of their proclivity is, by nature, a law motivated by hatred for their very being. This is almost exactly the logic Justice Kennedy recently used in a gay marriage SC case.

The reality, of course, is that people are rather more than any one characteristic they may have. The fact that this needs pointing out in our day and age is really sad!

The fact that someone is attracted to the same sex in no way negates all the other ways in which they are good people created in the image and likeness of God, even though fallen. What human can really claim any more?
