SIster Amy,

Talking about Women’s Rights, I was reading the Q’uran last night - actually to read the reference you gave at some point in the past - anyway, I kepted going and got to the part about divorce.

It seems that women, should her husband decide to divorce her, has many rights and those rights are protected through the Q’uran and Islam. Some rights, such as not having to give back to your husband what he gifted to you - whereas in the American Courts (at least in CA) you have to give back 50% of everything.

Have a great weekend!
Christy
Your statement that a wife has to give back 50% of what he gifted to you is completely wrong. (and I make my living practicing family law in California).

In California, everything that EITHER party acquires as a result of their efforts during the marriage is community property and the community property is equally divided upon dissolution.

Each party may keep what they acquired by means of gift without setoff.

Gifts to the wife (like jewelry) are hers to keep. Husband must ALSO share 1/2 of all he earned during the marriage with her.

I would be AMAZED to find any Muslim country treat women anywhere near that well.

Actually Muslim law treats them better.

if a husband devorces his wife. She doesnt ahve to share anything with him. He has to bear all expenses that she needs during and immediately after that devorce. Like rent and upkeep. he also is obliged to pay her sum of money that represents the years they have spent in marriage. ( estimated based on the his wealth as well)

If the wife decides to divorce the husband ( for no reason whatsoever other than she doesnt want to be with him and without stating any reasons) , she isonly obliged to give him back his initial wedding dowry . She doesnt again have to share wny of her wealth with him.

i know iof a case of a non muslim woman in a non muslim country her husband is not very faithful , she wants divorce and she cant afford it because if she devorce him she will have to pay this cheater half of her company that she worked hard to build. Now tell me how is that better than Islam !!!

That’s because everything belongs to him in the first place, including the woman!!!

Then why don’t the Muslims in California do that? You’re welcome to come to court with me, I’m currently handling a number of cases involving Muslims (Persians, Jordanians, Afgans) and none of the husbands seem to think the way you do. The do think Islamic law is better–because THEY have all the rights, all the power and the wife (and children) are chattel. I always assumed those expectations were fostered by their culture and Islamic law. Are their expectations that out of sync with Islamic law?

Muslims view marriage very differently from Christians. For Muslim men, a wife is for sex and children, not for a life companion in love. There is not the same concept of loving one’s wife, in Islam. Since marriages are arranged, they don’t even see each other until their wedding night, much less meet and fall in love. Love has very little to do with Muslim marriage and wives can always be replaced, usually with younger models.

IMO, inter-faith marriages between Muslims and Christians is a very chancy thing and to be avoided.
I was linked to this forum because I was searching for answeres to a question similar to the original poster’s.

Saudi culture is extremely strict, but I believe it is is a case of the religion being enslaved to the state, rather than a true interpretation of Islam. I have been in Iraq for 12 months, and none of the Iraqis I have met and befrended believe in the same brand of Islam as the Saudis. They are actually quite liberal. You are correct in your analysis of Fundamentalist Islamic law, but please do not think that every Muslim is the same.

As for there being no love in Islamic marriages… I met an Iraqi interpreter for the Coalition military, and he can read my heart like a book. He is the most caring person I have met in a long while…no marriage talk yet, at least not until he gets his US visa, but I would snap him up in an instant. I could go on forever about him, but I think it suffices to say that I speak from personal experience on the depth of their hearts 😃

It’s allowed in Islam. I would think it would be allowed in the Church so long, of course, the couple pledges to bring their children up Catholic.
in that case , it won’t be allowed in Islam . I read the fatwa that Children must be raised as Muslims.

Hi BaghdadBoricua,

Let me ask you- what do you know about men-women relations in Islamic law, and from what sources did you learn your information?

You bring up an important point- there is a difference between the religion versus the man.

Moslems are people like anybody else- there are good ones, bad ones, religious ones, apathetic ones, and so forth.

The individual believing Moslems does not necessarily represent accurately Islamic teachings.

As an example, Gov. Sebelius of Kansas is Catholic. She is also ardently pro-choice. She may be a Catholic, but clearly she does not practice her faith as her faith teaches it.

I am not criticizing this person you met. What I am saying is this: Don’t judge Islamic teaching on man-woman relatioship based on him. Judge Islam based on Islamic teachings from the original sources of Islamic doctrine, theology, and law.

These sources are the early writings such as: Bukhari, Muslim, Dawud, Majah, Tirmidhi, Ibn Ishaq, Tabari, Waqidi, Ibn Sa’d, and so forth.
