I put barring them from certain jobs and offices and imprisoning them for a set length of time. Honestly I think that those people who truly believe it is okay to murder babies need therapy. Yes, the public needs to be protected from their leadership but there is forgiveness for everyone, and everyone should have the opportunity for change. If they will not stop trying to kill people then they should be imprisoned for life. These people need help more than anything.

including the women who’ve had abortions, right?

German laws against murder, rape, and the like were legitimate, just as they are in every country.
And that makes the regime legitimate? Is it legitimate to not investigate the murder, rape or theft against a Jew? Do you mean to tell me that the Gestapo - the secret police - were a legitimate organization?
If a person supports legalizing the mass murder of a specific group, then they’re hate filled.
What about the person who supports the legal rounding up and punishing of people through ex post facto laws?

It was a legitimate political authority. It’s regular police were legitimate.

It’s not hateful to advocate the prosecution of crimes against humanity.

It [the Gestapo] was a legitimate political authority. It’s regular police were legitimate…
technically speaking, the reichstag passed the Enabling act every year giving full authority to hitler to dictatorate away to his black heart’s content.

the Gestapo was eventually taken under the control of the SS. these criminal entities were responsible for the deaths of millions of innocent victims.

which is precisely why they are the perfect model for your vision of a new america.

Would devoutchristian be so bold as to declare the Constitution to be an illegal source of government since it allowed abortion, contraception, pornography, etc.? Exactly what fundamental rights would the individual possess under this new system, if any at all?
Why not?

No one has a moral “right” to slaughter her child. No one ever has a moral “right” to publicly incite abortion, contraception, or any other immoral practice; government has a moral obligation to quash that. Since when has the Church taught that people must be allowed to do promurder marches and that we somehow have a moral obligation to support that? How ridiculous! Surely there is a hierarchy of rights? You might say, “The US government is not a Catholic government.” So what then, are we just to say, “Aw shucks, let’s give in to their system. The whole thing is flawed from the beginning, but because of some mental gymnastics and a weird combination of patriotism and a sense of untouchability of the Constitution, we just have to be content with low-level rallies* and marches.”

Is that what we are stuck with for the foreseeable centuries?

*not saying these things are bad, but they aren’t enough in an absolute sense

What makes devoutchristian the rule by which good government is measured? I prefer to follow Winston Churchill’s lead; “Democracy is the worst form of government except for all of the others.”

Unlike devoutchristian, I do not believe it possible to establish a perfect government. Fairwinds and I have been pointing to the fact that those men who did try to install perfect government ended up creating a state that was far worse and horrifying than what existed before. The attitude that usually exists in overthrowing a state that is perceived to be flawed or tyrannical is (to quote an early Bolshevik Cheka commander); “we don’t care about Justice; we’re here to settle accounts.”

Even the Vatican has not been immune lately to many trials and tribulations. The US Constitution may not be perfect, but I would take it over the starry eyed fantasies of one whose first inclination in starting a new society is to round up all of the abortion providers.

What here’s a crime against humanity?
we’ve given that a pass.

can’t make omelets without breaking eggs.

so far, we’ve decided to declare the constitution unconstitutional and arrest and try people on the Nuremberg model, meaning, fairly limited procedural rights and no appeal, with ex post facto application of laws when we get around to writing them.

we’ll apply the usual accepted notions of criminal justice against the defendants, meaning life in prison (standard for all murder cases) for any number of classes of criminals who participated in abortions.

starting, of course, with women who’ve had abortions.

surely you’d settle for nothing less.

That’s absurd. Was every arrest that occurred in Germany a kidnapping? If not then the state was legitimate.
“Following the defeat of the Third Reich at the conclusion of World War II in Europe, the party (the Nazi party, the ruling party of the state) was “completely and finally abolished and declared to be illegal” by the Allied occupying powers.”

the Nazi regime is not, perhaps, the best role model for our New America. but it was the target of the Nuremberg trials (the OP’s choice of justice) and enjoyed a certain level of success, so a comparison of methods is not out of order. the nazi-era Volksgerichtshof (People’s Court, not to be confused with the TV series of the same name) might be a model for how we shall dispense justice.

Of course. But that didn’t make the just actions taken by the German government illegitimate.

Sort of. The women who’ve had abortions certainly need therapy but I don’t think they should have any legal action taken against them. In my country, the people in government who are against abortion keep their mouths shut because if they voice any pro-life sentiments they’ll lose their careers. Abortion is totally normal here, so I think it takes away from the culpability of a woman who has an unwanted pregnancy and is already confused about what to do, and has the raging hormones of a pregnant woman ontop of that. It’s not the same as some robber smothering an infant to keep him quiet.
