Abuse as Grounds for Separation

Thank you again for the responses. I do not feel comfortable saying much further about the situation, as I am bound by confidentiality. That is also a big reason I have not been in “face to face” communication with a priest. But I will say that there are many people trying to help her.

**I feel that I may need to ask permission from her before I can discuss the situation with a priest. **Which is awkward, but I don’t know any way around it.

Are there any lawyers around here who know a delicate way of saying, “I need to talk to my priest about your situation because I can agree to represent you in a divorce action.” ???
Perhaps it would be better to encourage her to talk to a priest (one from another parish if necessary) rather than you talking for her.
 
Physical violence in any situation, in this case marriage (and it goes both ways too) is not acceptable. I was assaulted and an attempt was made on my life by my husband. Were there difficulties in the marriage and was his frustration justified? Yes. Did that give him the right to try to choke me to death, to break my nose and several ribs, and to cover me with bruises and then essentially (for the weeks it took for me to get the funds together to move out) threaten me with a shotgun? NO.

I obtained an annulment from the Roman Catholic Church with absolutely no problem. If you know of a situation wherein a woman is being abused physically, it is your responsibility to do whatever you can to intervene, and (if this is a neighbor) call the police.
I agree that any type of abuse is not acceptable and I’m glad you were able to get out.

On a separate issue, unless its too private to talk about, what was your annulment based on because while abuse is a reason to separate and divorce abuse that happens after a marriage has taken place is not grounds for an annulment. Grounds for annulment only apply up to the marriage taking place.
As I said if this is too private to talk about please just say so.

I think it’s unwise for an attorney to tell a client to go see a priest – I do not feel that it’s my place and it may have ramifications.

As I said before, there are many people trying to help her. She knows her options.

Am I missing something here? If you are her attorney why are you discussing this on a public forum?

I would never violate attorney-client confidentiality.
A lawyer’s use of a hypothetical to discuss issues relating to the representation is permissible so long as there is no reasonable likelihood that the listener will be able to ascertain the identity of the client or the situation involved.

This shouldn’t be forgotten that wives can be abusive too…

You wrote that earlier. And adults can abuse the eldlery. And children can abuse other children. Siblings can abuse each other. Doctors can abuse patients. And people can abuse animals. Ad infinitum.
