You’re the one making the claim. It’s up to you to support it. Defending it by saying @mrsdizzyd can’t say you’re wrong isn’t a defense at all.

Of course, and that being the case, in all charity shouldn’t we give the church the benefit of the doubt?

Mark 10:2-12

2 And Pharisees came up and in order to test him asked, “Is it lawful for a man to divorce his wife?” 3 He answered them, “What did Moses command you?” 4 They said, “Moses allowed a man to write a certificate of divorce and to send her away.” 5 And Jesus said to them, “Because of your hardness of heart he wrote you this commandment. 6 But from the beginning of creation, ‘God made them male and female.’ 7 ‘Therefore a man shall leave his father and mother and hold fast to his wife,[a] 8 and the two shall become one flesh.’ So they are no longer two but one flesh. 9 What therefore God has joined together, let not man separate.”

10 And in the house the disciples asked him again about this matter. 11 And he said to them, “Whoever divorces his wife and marries another commits adultery against her, 12 and if she divorces her husband and marries another, she commits adultery.”

The Church and her canonists are not ignorant of Scripture. You can keep quoting that verse, but it’s only applicable if they’re married. And as it’s been demonstrated earlier in the thread, just saying “I do” does not mean they’re married.

What you fail to on board is that an annulment finds that the two never became one flesh because one or the other or both could not have consented to the marriage or the marriage was in some way defective.

You are arguing that consent of the will does not matter and form do not matter.

Technically, one flesh refers to the sexual act.

The Tribunal investigates the wedding and consent to see if they resulted in a valid marriage.

Technically, yes. But the phrase has more than one sense. It is not merely about sex, but it also speaks to the oneness of the bond formed when one man and one woman decide to join together in matrimony.

Remember, marriages can be perfectly valid and not be sacramental.

True, but as another poster stated, Tribunals (and thus annulments) do not investigate whether or not a marriage was Sacramental, only if it was valid.

Too bad we cannot ask Jesus about annulment.
But I have a pretty good idea what he would say.
Kind of like when the Pharisees asked him about divorce.
Annulment sounds like something a lawyer would say as a loophole.

Respectfully, I doubt you do considering your view of annulment appears to involve destroying the marriage bond.

That is really not something you could prove.
I don’t doubt what you say, in theory, but what kind of “statements, behaviors, beliefs, indications” would qualify as proof, and how would you document it, to the satisfaction of a tribunal?
  • One of the spouses was having a secret affair with someone else before and after the wedding day?
  • One of the spouses went around telling family and friends “I don’t know if I should do this” in the days before the wedding?
  • One or both of them said after the wedding “I think we made a terrible mistake”?
Or something similar to that? And what level of proof would be needed?

You are referencing Deuteronomy 24

The letter he wrote and referenced was Deuteronomy 22 and the section about an invalid marriage.

What do the Saints and doctors of the Church say and teach about invalid marriages and Church decrees of nulity?
Might I recommend you contact your archdiocese canon law lawyers regarding this question? I bet you’ll receive the answer you’re looking for.
