A proposed law which passed the California Senate, the “Lesbian, Gay, Bisexual, and Transgender Long-Term Care Facility Resident’s Bill of Rights,” will criminalize referring to a transgender nursing home resident by his/her actual gender.

So far this law would apply to nursing homes and not other arenas.
 
Was this really a big problem to begin with? If one facility isn’t friendly to your preference then don’t you just choose another that is?
 
I would develop the habit of speaking with out pronouns, or first names, if needed.

This is just like bill C-16 in Canada.

"1. Failing To Use an Individual’s Preferred Name or Pronoun

"The NYCHRL requires employers and covered entities to use an individual’s preferred name, pronoun and title (e.g., Ms./Mrs.) regardless of the individual’s sex assigned at birth, anatomy, gender, medical history, appearance, or the sex indicated on the individual’s identification.

"Most individuals and many transgender people use female or male pronouns and titles. Some transgender and gender non-conforming people prefer to use pronouns other than he/him/his or she/her/hers, such as they/them/theirs or ze/hir. 10 Many transgender and gender non-conforming people choose to use a different name than the one they were given at birth.

"All people, including employees, tenants, customers, and participants in programs, have the right to use their preferred name regardless of whether they have identification in that name or have obtained a court-ordered name change, except in very limited circumstances where certain federal, state, or local laws require otherwise (e.g., for purposes of employment eligibility verification with the federal government). Asking someone their preferred gender pronoun and preferred name is not a violation of the NYCHRL.

In some languages, pronouns can be skipped altogether, like Latin or Polish.

I suspect any 1stAmendment challenge will strike these laws and give the suing party millions as compensation. Anyone want to join in on the suit?

That was my thought as well to avoid the problem. Good grief, a jail sentence?

Maybe it’s just me, but has the number of transgender individuals drastically increased or is it just the biased media coverage. I have only personally met one transgender person in my entire life (a college professor who announced his impending “transition” to the entire department in a special assembly. A friend of mine got formally reprimanded for not giving a standing ovation. Thankfully I was not present.)

Here’s what happens with identity politics:

You end up with preferred groups, and there are those will fake being in those groups because resources can be acquired on easy street from it.

A good example would be myspace 10 years ago. Being GLB was oh so :cool:. But in truth, a lot of people were saying they were bisexual, not gay or lesbian on their profiles. The reason is because they really weren’t that interested in the same sex as far as dating and more. So they picked bissexual because you really can’t question their orientation, and they can still date the opposite sex and save face---- so it’s deniability.

I think that’s why we have so many fake genders now. Because people want to be :cool: and trendy but without making the necessary sacrifice. So this allows people to be “trans” without actually transitioning through surgery. Not that they should, but it’s not even on their radar. We are just expected to accept whatever they want to be and not question them—or we’re bigots who must be silenced and fired ect ect.

But that’s not new. It’s the same baseline that people have used to get checks in the mail from the government and that in no small part is what lead to this in the culture.

So it’s much less about idealism and “equality” and more about money.
 
So what happens when police arrest…lets say a man that is transgender for a crime, and he tells them he is transgender, but they take him to the male jail section…Im assuming police would legally have to recognize whatever gender the person feels they are now instead of what they actually are.

seems like that could cause some other problems, namely, biological men being jailed in the womens section, or vice versa.

A first grader at a California charter school was sent to the principal’s office this week after she accidentally “misgendered” a classmate in what’s being called a “pronoun mishap.”
The incident occurred at Rocklin Academy, a school roiled by controversy after a kindergarten teacher led an in-class discussion on transgenderism that included a “gender reveal” for a little boy who was transitioning to a little girl. . . .
. . . . Parents were furious because they were not informed in advance and were not given the chance to opt their five-year-olds from the classroom transgender activity. However, school leaders informed moms and dads – they were not allowed to opt-out – and the state did not require them to notify parents.

Yes, I heard about a case along those lines, where someone who had legally changed sexes under state law (I think including surgery) was arrested by city police. The fingerprints or some other means of identification matched a prior arrest, and the arrestee was booked as a man. She was subjected to searches by male officers, and jailed with men, both in violation of state law. Despite her protestation about her status, the city police and jail pretty much ignored her claims for a couple days. I believe they later settled.

When we arrest a transgender person we are required to address them as whichever gender they prefer, and they have a right to be searched by an officer of the same gender. As of this point, if the individual is ultimately lodged in jail pending arraignment rather than released on an appearance ticket, he or she is still lodged according to biological sex.

I’m still waiting for the day when I am ordered to conduct a physical search of a biological female who identifies as male. Maybe I’ll make case law.
