Actually the Supreme Court will be hearing arguments about why it should hear the arguments.

From what I understand they are hearing 5 hours worth of oral arguments on several different issues. One of them is that. Something about some Act that may or may not apply. And if I recall, the Feds said it didn’t in the lower courts and have just switched their position.

One of the disputes was whether it was a tax during the debate they said it was not, now they sat it is.

LOL. I’d also hate to be a lawyer who prepares and spends 5 hours arguing in front of the Court only to have them turn around and say the timing isn’t right and to refile in a year.

It’s because they will lose if they use the Commerce Clause to force people not engaged in interstate commerce to buy a product and fine them if they do not buy said product. The taxing authority of the federal government has a better chance of winning.

However, it’s still unconstitutional to force a citizen to buy a product, to force a company to give a product away for free, and it’s unconstitutional to force a religious organization to violate it’s conscience. A triple play!

Of course the feds are doing this. The feds are led by Obama after all. I hope that the suit does not get dismissed. In fact, I hope that the suit succeeds.
