Should Trump and the rightist GOP just act as hypocrites in nominating a supreme court justice when 4 years ago they fought against the Democrats doing just that?
The people elected their state’s senators for 6 years (not 5 years and 321 days) and President 4 years (not 3 years and 321 days) to work the system to fulfill their campaign promises. What right do these elected officials have to stop pursuing those goals short of their term in office? None.

Two, and only two, of the three legislative bodies have the constitutional power and duty to appoint Supreme Court justices. In 2016 the Republicans held the Senate and the Democrats held the Presidency when Scalia died. Gridlock on an appointment ensued (just as the founders foresaw). In 2020 the Republicans control both because the people voted so in 2016 and, in the Senate, again in 2018. The stars have aligned for the conservatives. Politics is all about power.
 
But how about Chief Justice Roberts? He seems not to be as conservative as some had thought.
 
How about being intimidated by precedent set by a Republican Senate in 2016, which clamored not to give Obama the right to nominate his choice for the Supreme Court, which was farther in advance of the presidential election than now when people in some states are already voting?

The Democrats were not intimidated: Obama nominated Garland anyway, and had the Ds had a majority in the Senate, it’s certain they would have approved the nomination.

Just as certain as that if the Ds had a majority in the Senate now, they would not approve Trump’s nominee.

They never took away Obama’s right to do anything. Obama nominated Garland. The Senate, which has the right per the constitution, decided to not go forward with a hearing or vote.

Trump has the right to nominate a SC Justice according to the constitution. The Senate, again according to the constitution has the authority to vote on that nominee.

All other factors are irrelevant. All other factors are not law, not bound by the election process, not bound by anything that happened in 2016 or any other year. All other factor are especially not bound by the mistaken concept of what’s fair.

What President Trump is doing is constitutional, what the Senate is doing is constitutional and the left can whine and cry all they want but they know also Trump is able to do this.

I have thought this for a long time, ever since so many officials boycotted the inauguration of President Trump!!! It seems like it would be their duty in order to insure a smooth transition in the government!!!
 
Ha, ha! It just goes to show the utter hypocrisy and lack of principles of both major parties.
 
Oh yes, Trump is legally permitted to do this. I have no qualms with that. But should he? Whatever happened to ethical principles and the spirit of the law, let alone precedence? A silly question, for I know only too well there is little ethics or fair play in politics.

The fact that McConnell refused to give Obama’s nomination a fair hearing in 2016 even though it was several months before the election. The GOP’s reason: let the people decide by voting for a new President first. They had no ethical qualms about that. But now McConnell (and Trump) are trying to push through a Trump nomination as fast as they can even though we are closer to the election (in fact, some of the electorate have already voted) than we were in 2016. It shows just how hypocritical the Reps (and Dems) really are. Partisanship is everything to them; never mind principles.

Scalia died in February, 2016

Ginsburg died in September.

February is almost an entire year from Election Day and the inauguration.

The scenario is different.
 
And even that rather long time period wasn’t good enough for the Reps and McConnell. Now the shorter time period is not only good enough but imperative for them to take immediate action. Sheer, unadulterated hypocrisy.

It would be so much better if McConnell felt as compelled to take immediate action concerning a second stimulus package to help Americans who are unemployed and small businesses that are struggling. On that score, they sure take their time.

Which makes it even more unethical, since it is done out in the open with impunity. I did not say it was illegal.
 
Fair enough.

Make no mistake. I am not suggesting the Dems would not have done the exact same thing if the tables were turned. I have little admiration for the “unethical” tactics of either party.
