Is this just a straight across guideline? To me 15 over on an interstate is different than 15 over in a 25 zone. Also it is different to me if there is heavy traffic vs light traffic, weather conditions ect. Has your discretion been taken away in this? I understand trying to have a uniformed enforcement strategy but I also think there must be some discretion for the officers. I have given many warnings for 15 over, and I have written citations for 15 under. For me it depends on the zone, traffic and weather just to name a few.

Since I was assigned to the interstate unit, it was mainly a straight across guideline for us. Weather conditions would have an impact as did other mitigating factors (i.e. weaving in and out of traffic, reason for speeding, etc). The interstate here is a 12 mile straight stretch that deviates all of 1-2 degrees through the county and it’s a good road surface.
In the winter when it’s icy and snowy, the average speed is usually well enough below the speed limit that if someone causes an accident because they are going faster then everyone else and lose control, we write them for too fast for conditions. Also, in rainy or foggy conditions most people would slow down and we didn’t have many speeders. Not to mention that we use laser only which works only in light rain or light fog.
Our discretion wasn’t taken away in this, but the idea was that by having a set number you generally end up treating everybody the same. It avoids complaints of discrimination and/or bias. We were allowed to make exceptions for cause (and I did), but the Lieutenant didn’t want us doing that often.
Also, on a clear day, you could easily write 9 or more speed citations for 15 or more over. So there really didn’t seem to be much sense in targeting vehicles going slower then that.
Personally, I also thought that the vehicle was also a factor. There is a very big difference, in my opinion, between a good condition BMW (and any modern car, really) doing 75 as compared to a twenty year old Oldsmobile with a bad suspension and wobbly tire doing 75.
