A declaration of nullity (I believe is the correct term) is what is granted when it has been determined that there was no marriage to begin with.
i.e.There was never a marriage to begin with. So that means that no divorce is being “granted.” The “divorce,” when applying for this declaration, is a civil divorce, i.e. a legal divorce in the eyes of the law. Not church law.
How that is determined is is dependent on each case. Regardless, it looks as if you have your own misconceptions and misunderstandings about the Catholic church.![]()
