Should Chief Justice Anthony Kennedy be excommunicated?

With his continued rulings on the matters of Abortion and Same Sex Marriage he has been completely out of step with the Catholic teachings on these subjects.

Also with the recent Supreme Court ruling on legalizing Same Sex Marriage throughout America this has essentially destroyed the Traditional Meaning of Marriage which he voted in favor of. This is surly more than enough reason to support him being excommunicated.

I’m just astonished how much Catholics lawmakers can go so far away from Church teaching and still claim to be Catholic.

Excommunication is between Mr. Kennedy and the Church; the best we can do is pray that from now on he makes his legal decisions according to the Holy Divine Will, not his will.
 
No, He would not be excommunicated.

All he did was trample States rights and reject the Fourteenth Amendment to the Constitution. Not a religious concern.

He also contradicted a previous Supreme Court decision…the overturn of the Defense of Marriage law. (DOMA)
Kennedy supported the overturn by writing:

“The history of DOMA’s enactment and its own text demonstrate that interference with the equal dignity of same-sex marriages, a dignity conferred by the States in the exercise of their sovereign power, was more than an incidental effect of the federal statute. It was its essence.

His latest decision now removes this exercise of sovereign power from the States and puts marriage under control of the Federal Government.

Rather than excommunication, Justice Kennedy should be impeached under Articles I and II of the Constitution.
 
The justice who wrote the Roe v Wade decision wasn’t excommunicated.
 
Excommunicated for doing his job and interpreting the Constitution and civil laws written as he sees them to be even when Catholics don’t agree with his interpretation? His employment is as a juctice of the SCOTUS. He is not employed in a Vatican or Church position.

Yes, and he isnt the chief justice. Roberts holds that title.

In Muslim countries, most judges will not stray from Islamic teaching.

That’s the best reason I’ve encountered for a judicial that is based on law and not religion. Take a look at Iran, Saudi Arabia and even Turkey - those are states run on religious law instead of civil law. It makes no difference if you happen to be part of the mainstream faith or not, if you live there, you must obey their laws. Talk about the slippery slope.:eek:

  1. Justice Kennedy is NOT the Chief Justice. Chief Justice Roberts is the Chief Justice and he voted against SSM.
  2. I doubt that excommunicating Justice Kennedy nor Justice Sonia Sotomayer would make a difference. The goal of Excommunication is to be bring the sinner in line with Church teachings. I doubt excommunicating them would accomplish that goal and MIGHT make it much harder for orthodox Catholics to win elections (which we need).
 
Objectively speaking, both “Justice” Kennedy and “Justice” Sotomayor are already excommunicated latae sententiae.

I’m quite sure he has already self excommunicated himself. The lawmaker, judge, “doctor,” husband demanding and paying for it, and the woman having it are all culpable for the death of a child when it comes to an abortion. His gay “marriage” ruling is just the cherry on top.

Except that he was not doing his ‘job’ in following the actual Constitution, but allowed his personal politics, and thus his moral conscience in contravention of Catholic doctrine and teaching to prevail. It does matter. There simply was not an actual Constitutional basis for the majority holding.
