Because you started the conversation about things that are both historically inaccurate and just plain dumb?

Jimenez said seeing the hat had the same effect on him that a Ku Klux Klan hood would have had
Officer Carlos Ortiz, a police spokesman, said SAPD has heard from a number of people who believe Jimenez should have been charged with assault rather than theft.

Except I didn’t. The poster who thought it appropriate to compare this thread’s subject to Brownshirts did. Your comment in response to mine amounts to nothing more than whataboutism. It’s a bad look.

if someone through a soda all over me, i would consider that assault. even grabbing the hat off of my person i would
consider assault.
theft would be my hat on the table and someone walked by and took it.

And you’d be right. If the same was done to a police dog, not even a human, there would be an assault charge. It would also probably be a felony.

It’s clearly a misdemeanor to do that to a police dog
Sec. 38.151. INTERFERENCE WITH POLICE SERVICE ANIMALS.

And theft charges would apply equally.

It rises to felony with injury. So that would depend on the liquid thrown.

I’m not sure when theft rises to felony.

And your link seemed to be for pending legislation.

Oh it is no doubt a crime. I don’t know Texas law. But the trend is for any crime against a government agent to be more serious and for their dogs (and everyone’s really to be treated like people. Give it a few more years and it will be a felony.

Hence ‘probably’.
Though new legislation may be what you referenced, I’m sure you understand they have statutes they already use to prosecute people who attack police dogs.

Huh? Following the thread, the comment that I responded to was the claim that it would probably be a felony.
You posts to me are unconnected.

Your research was weak, or you ignored the obvious hits on the topic.
Under the Federal Law Enforcement Animal Protection Act, which went into effect this week, anyone convicted of purposely assaulting, maiming, or killing federal law enforcement animals such as police dogs and horses could be fined at least $1,000 and spend up to 10 years in prison. Previously, the animals were covered by a variety of state, rather than federal, laws.

I think the “bad look” is being unwilling to acknowledge that comparisons between US immigration policy and the Holocaust are at least as ahistorical as comparisons between Nazi Brownshirts and Antifa Blackshirts.

And also with you.
Texas Law:

Not a felony.
Federal Law:

Whoever willfully and maliciously harms any police animal, or attempts or conspires to do so, shall be fined under this title and imprisoned not more than 1 year. If the offense permanently disables or disfigures the animal, or causes serious bodily injury to or the death of the animal, the maximum term of imprisonment shall be 10 years.
A felony in the case of permanent disability, disfigurement, serious bodily injury, or death; otherwise a misdemeanor.

Throwing a consumable beverage at a police dog in TX does not appear to be a state or federal felony.

@dvdjs
ROFL, it was your link that said it could be a felony if the injury was serious.
I never suggested that applied in this instance.
Stop fabricating controversy.

All of these comparisons have zero to do with the thread.

Under serious conditions of injury. You might not have been talking about the case at hand on this thread. But that is what was being talked about until your scramble.

Here is how the conversation started:
if someone through a soda all over me, i would consider that assault. …
And you’d be right. If the same was done to a police dog, not even a human, there would be an assault charge. It would also probably be a felony.
Probably not.
You decided to weigh on on my reply to @exnhillo.
Throwing soda. At a police dog, probably a felony.
Time to follow the advice you so liberally give to others.
