Temporary Marriage was allowed in islam.

At some point it was forbidden.

Wonder if anyone knows when and how it was forbidden.

Temporary marriage/ fixed term marriage (Mut’ah) is allowed in the Qur’an and by the prophet. Khalif Umar was the one who forbade it. It’s reported Umar banned temporary marriage with the following words

“Two Mut’a were practiced during the time of the Prophet: Mut’a of women and Mut’a of Hajj, but I forbid both of them and will punish anyone who practices either.”

The sunni view is that temporary marriage was allowed in the early years, then abrogated in the later years

the shia view is that it has always been permitted by the prophet and Umar forbade it

My understanding is that Umar was asked about a legal ruling of what happens to the child born out of Mut’ah. Rather than answer with the legal ruling he decided to ban it all together. Historically there were many companions who disagreed with Umar’s ruling and continued to practice Mut’ah regardless.

The hadith forgers who came many years after Umar wanted to restore Umar’s credibility and forged false hadiths stating the prophet had forbade Mut’ah. A closer examination of the hadiths reveals many inconsistencies and contradictions and raises more questions than can be answered.

To give a ‘one night stand’ a name other than a ‘one night stand’ (sometimes it is only for a few hours), and then so they can tell us how superior they are and how decadent we are.🤷

Yes, they know it is temporary.

I do have a question though… What if the woman gets pregnant from this one night stand, oh er I mean ‘temporary marriage’? Is she stoned because the marriage only lasted for a short time and if she is granted the favor to live by the muslim men, how does she collect child support in sharia law courts? Or is this a case of the man taking the child because he is the man?

In Islam, relationships between a man and woman are permitted only in marriage. The marriage can be either permanent or temporary. Yes both spouses know they are in a temporary marriage, the terms and conditions are set by the woman. People enter into fixed term marriages for many different reasons, sex is not the sole reason. In fact, when I met my wife we couldn’t simply start dating because it’s not allowed in Islam. I told her that we’d have to be in a temporary marriage. she thought it was strange, Initially we agreed for 3 months, then extended it for 6 months and so on. we were together for almost 2 years before we got married permanently.

I too was not aware that mut’ah was permissable according to the quran.

But it seems that it is part of the quran and both shi’i and sunni ulama agree that the following verse refers to the permissablity of temporary marriage.

Lawful for you is what is beyond all that, that you may seek, using your wealth, in wedlock and not in licence. So those of them whom you enjoy, give them their appointed wages; it is no fault in you in agreeing together, after the due apportionate. God is All-Knowing, All-Wise’ (4:24)

The words “those of them whom you enjoy” refers to temporary wives.
It specifies that there is no evil in ‘muta’a’.

Qur’an 4:24 “…So for whatever you have had of pleasure (Istamta’tum) with them by the contract, give unto them their appointed wages as a duty…”

The arabic word used for temporary marriage is “Istamta’tum” comes from the root word “Mut’ah” which is more accurately translated as pleasure. Another phrase for temporary marriage is “pleasure marriage”

Moreover, if you look at the commentaries of this verse you will see that some companions understood it to mean temporary marriage. I quoted the sunni commentaries for your benefit

Tafsir al-Kabir, by al-Tha’labi, under commentary of verse 4:24 of Quran;
Tafsir al-Kabir, by Fakhr al-Razi, v3, p200, commentary of verse 4:24;
Tafsir al-Kabir, by Ibn Jarir al-Tabari, under commentary of verse 4:24 with authentic chain of narrators, v8, p178, Tradition #9042;
Tafsir al-Durr al-Manthoor, by al-Suyuti, v2, p140, from several chain of transmitters;
Tafsir al-Qurtubi, v5, p130, under commentary of verse 4:24 of Quran;
and many many more report that

“Ali (RA) said: The Mut’a is a mercy from Allah to his servants. If it were not for Umar forbidding it, no one would commit (the sin) of fornication except the wretched (Shaqi; an utmost wrong-doer).”

Absolutely, the woman sets the terms and conditions and the man either accepts or rejects her proposal, she can demand anything she wants, they both have to agree on those conditions including the wedding gift. Once accepted both the man and woman are required to be together in good will under the agreement terms or terminate the marriage at any time. The marriage can be terminated by either the man or woman.

I am shocked that how some Muslims are making fun of God’s laws. If you read carefully all the verses regarding marriage , you will see how Allah told us a believing woman is a partner of a believing man ; how they must help eath other to do good deeds , to help each other in pleasing God & get rewards on the Final Day. That’s the ultimate goal of a couple to live a rightous life .

Answer Mut’ah marriage is permitted by Shi’a schools of thought. Not one Sunni school allows it. It is a marriage that must fulfill all the conditions, but it is stipulated for a certain period. They use the verse in the Quran “ and what you seek pleasure from them then give them their dowry”. **This allows marriage and not mut’ah.

They also use a narration that the Prophet SAAS allowed it, but the truth that this is incorrect for their six narrations in Bukhary and Muslim that forbid it. If a child is born out of a temporary marriage, both parents are equally responsible for the child’s upbringing, otherwise they would be neglectful of their duties. This is the same as a couple who marry permanently and then divorce after having children.

As I said people enter into a temporary marriage for many reasons but the guiding factor should be to seek protection from sin and not moral lapse.

Yes, also the shia position is more practical. As you know it is very difficult for a muslim woman to get a divorce in a permanent marriage under sharia. she has to go through a long and drawn out process to get it. Also, because pre-marital relationships of any kind are not allowed, the couple really don’t have an opportunity to get to know one another before marriage. Temporary marriage allows them that opportunity to get to know one another under the terms of the marriage enabling them to make a better informed decision about whether to permenantly marry or not to marry the person they are with.

And finally, young men and women with repressed sexual desires have a higher likelihood of falling into sin. Especially those who are not in a position to be permanently married for one reason or another. Temporary marriage provides an avenue to have a legitimate relationship without falling into sin.

So , it’s ok for a Muslim Woman to say to a man - marry me for 2 hours & give me some dollars as Mahr. Then the man will enjoy & leave her after 2 hours . Then she can go to other man & say the same or she needs to pass her Iddat time ?

Men can go to women for 30 minutes , 1 hours by making contract ?? What’s the differences between Prostitues & their customers and people of Mutah marriage??? Sorry If I am rude but I am trying to understand.
 
**I am sure there is no allowance for any temporary marriage in Islam. There is no verse in Quran allowing any temporary marriage i.e. Mutah. I present a good verse from Chapter 5 of Quran, verse No. 5.

" This day (and forever after this day), all good things are made lawful for you (Muslims). And the food of the people of the book is lawful for you. And your food is lawful for them (people of the book).

And the chaste ladies from the believers and the chaste ladies from the people who got the books before you (i.e. Jews and christians, are lawful for you) when you give them their dowries, taking them in permanent marriage (fortified care) niether fornicating nor taking them for paramours in secret (i.e. Mutah).

And whoever will disobey the tenets of the faith, his all deeds will be null and void and he will be of the losers in the end."**

The above verse is telling what is allowed and what is not allowed… It is strictly telling that there should be no secret affair. All should be open and clear declared well known relation only.

She would need to pass her Iddah, for those that don’t know this is a time period of 3 months before she can remarry again.

Planten, the difference here is that a woman can demand celibacy for the duration of the term. In other words, they don’t have to have sex for a mut’ah marriage to be valid.

They will keep fasting regularly , lower their gazes , keep a safe distance from the opposite sex . Moreover they must fear God to avoid the major sin.
