This is what I’m talking about. My understanding is that this is an authority a congress in the past has granted the president. That’s what I meant. Correct me if I’m wrong.

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.
This is 8 Us Code 1182. I guess for this to tie with 8 US Code 152, the “class” of aliens can’t be discriminated against due to nationality.

Can you link me to that? I can’t find it.
Sorry, it’s 8 US Code 1152:

(a) Per country level
(1) Nondiscrimination
(A) Except as specifically provided in paragraph (2) and in sections 1101(a)(27), 1151(b)(2)(A)(i), and 1153 of this title, no person shall receive any preference or priority or be discriminated against in the issuance of an immigrant visa because of the person’s race, sex, nationality, place of birth, or place of residence.

I read the sections that 1152 states are exempted, and they all seem to be talking about work (for example, most of 1153 is spent talking about immigrants who are skilled workers, baccalaureate degree holders and other laborers). In fact, 1152 itself really only discusses employment and not national security, making me wonder if 1182 would still be a valid defense for Trump’s EO.

Yeah, I’m not a lawyer, so I don’t know.

I don’t think it’s very American to restrict little old ladies and five year old kids from entering the US because they come from a Muslim-majority country that doesn’t have a Trump hotel.

We are a nation of immigrants. In a bid to** fee**l safer, we are trashing our national charism. Note I said feel safer, not be safer. None of the seven countries is a problem in terms of immigrants killing Americans on US soil.

It’s only a temporary measure until a system can be put in place to properly vet everyone (as I understand it). Besides, most of the people I’ve seen on the news are men, not old ladies and kids.

Unless Trump thinks he can weaken the Judicial branch of government.
Most people don’t know that Obama did not ask permission from Congress before waging war on Libya was therefore unconstitutional because the media’s coverage is bigoted. Imagine all the friction and frustration they are causing between friends and family due to this lack of communication. Sad.

Legal immigrants. To your second point, I would like to keep it that way, wouldn’t you?

What do you think his federal judge appointments will be all about.

What war on Libya? What is this, more "alternative facts?

I hear a lot about biased press and i know that in some cases it’s true, but that’s reserved for Breitbart and some of the others.

There are at several things that Founding Fathers Thomas Jefferson and Thomas Paine stated that apply here.

“The natural progress of things is for liberty to yield and government to gain ground.” -Thomas Jefferson

“Our Liberty depends on the freedom of the press, and that cannot be limited without being lost.” Thomas Jefferson, letter to James Currie 1786

“Were it left to me to decide whether we should have a government without newspapers, or newspapers without a government, I should not hesitate a moment to prefer the latter.”- Thomas Jefferson

“I know of no safe depository of the ultimate powers of the society but the people themselves; and if we think them not enlightened enough to exercise their control with a wholesome discretion, the remedy is not to take it from them but to inform their discretion.” -Thomas Jefferson

“Society in every state is a blessing, but government, even in its best stage, is but a necessary evil; in its worst state an intolerable one.” -Thomas Paine

And I would add a couple of quotes from Clarence Darrow as well…

“As long as the world shall last there will be wrongs, and if no man objected and no man rebelled, those wrongs would last forever.” -Clarence Darrow

“The world is made up for the most part of morons and natural tyrants, sure of themselves, strong in their own opinions, never doubting anything”- Clarence Darrow

In reading articles around the internet and this forum, the acting AG is being praised by the same folks who ripped into Kim Davis for refusing to do her job. Interesting.

Her job actually includes saying no to the President when necessary. No less than Sen. Sessions made that point to her explicitly in her confirmation hearing. Normally this is done behind the scenes, but Trump did not involve the appropriate people in vetting this rash scheme.

The comparison to Kim Davis is specious.

The hypocrisy is stunning and unnerving

Senator Jeff Session who was appointed by Trump to be the new AG
"If the views a President wants to execute are unlawful, should the Attorney General or the Deputy Attorney General say no?" Sessions asked.

"Senator, I believe that the Attorney General or the Deputy Attorney General has an obligation to follow the law and the Constitution and to give their independent legal advice to the
President," Yates said.

Attorney General Nominee Jeff Sessions Once Grilled Sally Yates About Standing Up to the President

When Sally Yates was confirmed as deputy U.S. attorney general nearly two years ago, she assured Alabama Sen. Jeff Sessions that she would be willing to stand up to the President if he took “unlawful” action.

Before Trump election:
Ryan called Trump’s proposed ban on Muslim immigration “unconstitutional,” blasted his attacks on a Mexican-American judge as “racist,” and chided the candidate for refusing to quickly disavow support from a white supremacist.

Before Trump election: Calls to ban Muslims from entering the U.S. are offensive and unconstitutional.— Governor Mike Pence (@GovPenceIN)

It’s amazing the lack of integrity and how the desire for power can corrupt so many.

Probably because Davis refused a law due to “religious beliefs” where Yates upheld the law.

nytimes.com/2011/03/22/world/africa/22powers.html

“WASHINGTON — President Obama is facing criticism that crosses the political divide for not seeking Congressional authorization before ordering the American military to join in attacks of Libyan air defenses and government forces.
Some Democratic lawmakers — including Representatives Jerrold Nadler of New York, Barbara Lee of California and Michael E. Capuano of Massachusetts — complained in a House Democratic Caucus conference call as the bombing began that Mr. Obama had exceeded his constitutional authority by authorizing the attack without Congressional permission.”

And he removed Qaddafi from power. The irony is that the law allows the President to ask permission from Congress retroactively within 60 days. All he had to do to make the action legal was to file the paperwork, but he didn’t bother.

But it is NOT a Muslim ban. And it’s temporary too until a better vetting process is in place. The outcry now is more on the symbolism rather than the actual executive action which is not unprecedented.
