Then you should be equally critical of neo-cons like Paul Wolfowitz, GWB, and Cheney…and you should be scared to death of Gingrich and his concept of foreign policy through regime change.
But more to the point:
Art. 2(3) of the UN Charter “All Members hsall settle their international disputes by peaceful means in such manner that international peace and security, and justice, are not endangered.”
Art. 2(4) of the UN Charter “All members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the PUrposes of the United Nations.”
That general rule has 2 exceptions:
Art. 42: “Should the Security Council consider that measures provided for in Article 41 would be inadequate or have proved to be inadequate, it may take such action by air, sea, or land forces as may be necessary to maintain or restroe international peace and security.”
or
Art. 51: “Nothing in the present charter shall impair the inherent right of individual or collective self-defense if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security.”
That’s the basic rule under international law for the legal basis for the use of force against another nation. Here is what the U.S. Constitution say about war: “Congress shall have the Power to declare War …”
So, that’s our baseline under domestic law for declaring war.
So what was the basis for the use of force in: Panama, Grenada, Libya, Bosnia, Iraq, Pakistan, the military violation of Iran’s territory, Yemen, etc?
Would we go to war to protect Taiwan? What would be the basis for the use of force?
Would we go to war to in Iran over suspected nukes? What would be the basis for the use of force? (BTW, how does DPRK, which we know 100% to have nuclear weapons, differ from Iran? And which country is less predictable and more likely to start a war? Oops…).
And how does Libya differ from Syria (or any number of African countries that are engaged in civil war and slaughtering civilians)?
Riddle me this: Which candidate, from either party, has the greatest respect for the rule of law?
Did you know China has not gone to war since 1979? Can you even contemplate going 32 years in the United States without being at war?
Really, who is in favor of our current trend of resorting to military force as (almost) a first course of action? It’s absurd, it’s illegal, and it’s immoral. We continue to elect leaders that think the concept of Just War Theory is the punchline to a joke.
