So the judge struck down all laws related to prostitution because they hinder people’s “freedom of security” (because they can’t go to cops while they’re in the process of committing a crime…), and “freedom of expresion” (because they can’t approach people to ask them if they want to pay for sex… not that this stops them).

Thankfully this isn’t the Supreme Court, although I imagine they’ll rule the same way.

Canada’s laws regarding prostitution differ from the US, because even prior to this ruling prostitution was legal in Canada. What was illegal in Canada was operating an establishment which provided prostitution, supporting oneself on the wages of prostitution and soliciting for prostitution. To my eyes, that appears to be a strange arrangement.
If upheld on appeal, the decision will plunge Parliament back into the extremely divisive and complicated job of criminalizing an activity that is not itself illegal.

According to the Globe and Mail, the ruling applies immediately to Ontario. If the ruling is upheld on appeal, it will apply to all of Canada.

It really was a strange arrangement, but the law made it impossible to engage in prostitution without breaking one law or another. I think it would be like not making murder legal, but then making it illegal to use a weapon to kill someone, a weapon being legally defined as an object used to assault someone… the act may not be a crime but everything around it is. Silly, yes, but it works to the same end.

Interesting, what I read was the judge ordered a stay of 30 days while the government figured out what to do. I was under the impression, though I am no lawyer, that a stay of decision is common to the appeals process.

I guess we’ll see.

Officially we do, but I know, personally, people who have been taken before extrajudicial tribunals for saying the wrong thing, so I’ll agree with you.
 
Sorry, I can’t resist this: Does the law permit prostitution if one is a “hobbyist” rather than a “professional” (making enough money to support oneself?)

All joking aside. This is both reprehensible and absurd.
 
Why are our courts making laws and not the government?

Who in their right mind wakes up one day and says, “You know, I wanna be a sex worker”?

The illegalization of victimless crimes, such as prostitution, is ridiculous. It is just a certain group of people claiming they have more right to impose their beliefs on you than you have of exercising your rights to use your body as you see fit.

Prostitues are the victims of this crime. Just look at the circumstance surrounding prostitutes, and why they enter such a profession.
 
Not without the risk of being pulled in front of a human rights tribunal.
