It wouldnt make a difference, the legislature would just say police need this ‘tool’ in order to do their jobs effectively and find drugs.Well, you have no choice in the matter because a canine sniffing around your car is not considered a search, at least not in most states. Again, if you don’t like the law, take it up with your legislature.
However, I do not think its right for them to be able to use a dog around the outside of car, that dog is an ‘employee’ of the police dept, as people that have injured drug dogs, have been charged with assault on an officer, even though its a dog, and that dog IS SEARCHING, by means of sniffing around the car for drugs.
IMO, in a traffic stop, if the owner, driver of the car tells police NO to ANY searches, thats it, nothing more they can do, and they must then leave…they would say this is a set back in their efforts to find drugs, but thats not an issue IMO, the so called war on drugs has been lost miserably for many years, Id think by now, most police would recognize and accept this fact, instead of trying everything they can to find them and arrest people, MUCH more important things for them to focus on in my opinion anyway.
