POLL: If Kavanaugh were proven guilty

Juvenile records are expunged. It’s a leap to call something “sexual assault” that never got to trial and I believe this is a classic smear campaign and witch hunt. Only 25% of women believe this happened.

Even if this happened, I’m not sure what the charge would be. And then, it’s a whole 'nothing thing to convict. None of the witnesses have come through for her. What will those who are harsh on Kavanaugh think if Dr. Ford does not even show up to testify? Will they acknowledge then, this is likely fabricated?

What does any of this have to do with the hypothetical posed in the question?

It’s a hypothetical question. It doesn’t matter if it can or can’t become a reality.
This reminds me of an old “SNL” skit. Somebody would pose a question like “What if Julius Caesar had a Piper Cub?” or “What if Superman had landed in Nazi Germany rather than Kansas?”, and scholars would have “serious” discussions about the topic. It was a hoot.

Or maybe it’s like that ol’ saw, “Have you stopped beating your wife?”

No hoots guaranteed here. No conversation, serious or otherwise, is needed here either for that matter. It’s a poll.

I’m not sure that phrase — or the actual fallacy to which you’re alluding — means what you think it means.

If it is “proven” in a court of law, it would likely keep the man off any bench to which he would otherwise be appointed.
Sort of a “well duh” there.
What is your point to this thread?
It seems like it’s asking a very obvious question for the sake of starting arguments.

The question is whether people would see sexual assault committed as a teenager as a reasonable preclusion to a lifetime appointment on SCOTUS. Apparently you don’t?

Sorry, you did not set the initial conditions. I made my comment based on current conditions, where there has been no legal statement made against the judge. Do you wish to rephrase you hypothetical to include, “assuming charges were filed that led to a trial?”

If the claims are shown to be true, then Kavanaugh lied to Congress about it.

That is most certainly relevant to a judge’s character

If the claims are shown to be true,
There is no way to show that the claims are true with no corroborating witnesses and no physical evidence, which is the current state.

One would think. But thus far there have been votes saying he should still be appointed.
And there has been an amazing amount of discussion here behind that perspective.

If he is guilty and has lied about the event, then I would argue that he is clearly not fit for the Supreme Court. If he admitted guilt and showed repentance, then my answer would be a big maybe. He has no positions on anything that I know of that I would object to, so if there were no scandal I would be perfectly fine with him on the court.

This one concern is pretty big for me but if it weren’t there, I might be good with his appointment, as well.

What about an teenager guilty of a crime. Should they be given the chance to become participants in society. SHoul d their records not be expunged so that it follows them throughout their lives?

That’s a great question. Yes, they should be given the chance to become participants in society. I’m not prepared to give them lifetime appointments on the highest court in the nation depending on the nature of their crimes. But to become participants in society? Yes.

Apparently Feinstein has never released the letter from Ford, and to my knowledge Ford has never been specific about what she claims Kavanaugh did. So in asking what one would think if Kavanaugh was “proven guilty” one needs to first specify just what he is “proven guilty” of.
