No. That Ninth Circuit case said the government can’t do that. They can’t be held by ICE at all. That’s why they are turned over to HHS. HHS can’t detain the adults.So kids should go to prison with adults-maybe even violent criminals. What could possibly go wrong?

When an person is prosecuted for illegal entry he is taken into custody by US Marshals. Nowhere in the US do the marshals care for the children of the people they take into custody. The options are these: “catch and release” anyone entering the US with a child, incarcerate the parent but not the child, incarcerate the parent and the child. What is happening to illegals is in no way different from what happens everywhere else in the US when an adult is arrested for a violation of the law. I’m pretty sure civics classes cover that concept.It is not a law, it is a policy. You should have paid better attention in Civics class.
